Notification of dangerous non-food consumer products to the market surveillance authorities

Chapter III of the Law on General Product Safety (Official Gazette of BiH, 102/09), prescribes the obligations of manufacturers and distributors regarding product safety. Manufacturers and distributors are obliged to immediately notify competent surveillance authorities if they determine that the product they have placed on the market poses risks for consumers and is not in compliance with the general safety requirement.

The notification shall be submitted using the prescribed form and shall contain at least the following:

• data enabling identification of the product or its batch;

• a full description of the hazards or risks presented by the product concerned;

• all available information necessary to ensure product traceability; and

• a description of the actions or measures taken to prevent risks to consumers.

The Council of Ministers of Bosnia and Herzegovina adopted the Decision on the Form and Contents of the Notification of Dangerous Products (Official Gazette of BiH, 55/10) in accordance with Article 11 (3) of the Law on General Product Safety. The Decision contains:

• Guidelines for notification of dangerous consumer products to the competent authorities by manufacturers and distributors (Annex I) which clarify the conditions and procedures for notification,

• Notification form (Annex II), and

• Methodological framework for risk assessment (Annex III).

This Decision transposes the Commission Decision 2004/905/EC, which establishes guidelines for the notification of dangerous consumer products by manufacturers and distributors to the competent authorities of the Member States, in accordance with Article 5(3) of the Directive 2001/95/EC on General Product Safety.
