Notifications in the EU - Safety Gate
Safety Gate, formerly known as RAPEX (The Rapid Alert System for Non-Food Products), is the European Union system for rapid exchange of information on dangerous consumer products, excluding food, medicines, and medical devices. This system serves to notify about dangerous products found on the market of the European Union and measures taken by competent authorities from the EU member states, as well as economic operators responsible for placing the products on the market.
The European Commission regularly publishes the above-mentioned alerts about products that pose a risk to consumers on its website https://ec.europa.eu/safety-gate-alerts.
The Safety Gate system operates through competent authorities from the EU member states sending daily notifications about dangerous products found on the market via their official contact points. The notifications contain all available data on the dangerous products, the risks they pose, as well as the measures taken/ordered by the competent authorities or measures voluntarily taken by economic operators. After being informed about all this through the Safety Gate system, other EU member states have the obligation to investigate whether the product is present on their market and to share information if they find that product on the market.
The legal basis for implementation of the Safety Gate system in the European Union is the Regulation 2023/988 on General Product Safety, which applies from December 13, 2024. This Regulation replaced the Directive on General Product Safety (2001/95/EC). The guidelines for the management of the Safety Gate Rapid Information Exchange System were established by the Commission Implementing Decision (EU) 2019/417 of November 8, 2018, and the successive amendments adopted by the Commission Implementing Decision (EU) 2023/975 of May 15, 2023.
Given that the Directive on General Product Safety was previously transposed into the legislation of Bosnia and Herzegovina in the form of the following laws: the Law on General Product Safety and the Law on Market Surveillance of Bosnia and Herzegovina, this entails the obligation to monitor safety of non-food consumer products on the market and to inform the public about dangerous products.
